Terms of Service

1. Acceptance of Terms

By accessing or using CreatiweOS (the "Service"), operated by Creatiwe Global Pvt. Ltd. ("Creatiwe", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users, including clients, agency partners, and Creative Scientists. Additional terms may apply to specific features or programs and will be presented to you at the relevant time.

2. Description of Service

CreatiweOS is an AI-native creative operating system that pairs Brand Brain technology with a curated network of Creative Scientists to deliver compounding creative output. Services include brand intelligence, creative mission delivery, and ongoing creative operations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your account credentials and for all activity under your account.

You must be at least 18 years old and have the legal authority to bind your organization to these terms. Notify us immediately at hello@creatiwe.com if you suspect unauthorized use of your account.

4. Subscriptions and Billing

CreatiweOS operates on a subscription basis. Pricing, billing cycles, and included deliverables are defined in your subscription agreement or order form. All fees are non-refundable unless otherwise stated in your agreement.

We use Stripe for payment processing. By providing payment information, you authorize us to charge the applicable fees. Failure to pay may result in suspension or termination of your account.

5. Intellectual Property

Client content: You retain ownership of all materials, brand assets, and content you provide to us. By uploading content, you grant us a limited license to use it solely for the purpose of delivering services under your account.

Deliverables: Upon full payment, all creative deliverables produced for your account are assigned to you. You receive full ownership and usage rights.

Platform IP: CreatiweOS, including the Brand Brain engine, workflows, algorithms, interface, and documentation, remains the intellectual property of Creatiwe Global Pvt. Ltd. You may not reverse-engineer, copy, or redistribute any part of the platform.

6. Acceptable Use

You agree not to use CreatiweOS to: upload or transmit content that is unlawful, defamatory, or infringes on third-party rights; attempt to gain unauthorized access to any part of the Service; interfere with the platform's security or integrity; or use the Service for any purpose that violates applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

7. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This includes, but is not limited to, business strategies, product roadmaps, brand guidelines, and creative briefs.

Confidentiality obligations survive termination of the agreement for a period of two (2) years.

8. Limitation of Liability

To the maximum extent permitted by law, Creatiwe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims related to the Service shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the subscription by providing written notice as specified in your subscription agreement. Upon termination, your access to the Service will be revoked, and your data will be retained for 90 days before permanent deletion.

Sections relating to intellectual property, confidentiality, limitation of liability, and governing law survive termination.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes your acceptance of the updated terms.
